What’s Changed About Buyer Agent Fees?
In 2024, there were big changes in how real estate commissions are handled. In the past, the seller usually paid a commission to both their agent and the buyer’s agent. That was often built into the sale price and not something buyers had to think much about.
Now, it’s different. While some sellers still offer to pay the buyer’s agent, it’s no longer guaranteed. That means buyers may need to have a separate agreement with their agent—and they might be responsible for some or all of that fee.

Understanding Buyer Representation Agreements
With the recent changes to how real estate commissions work, one of the biggest updates for buyers is the requirement to sign a buyer representation agreement before touring homes.
This agreement is a formal way to make sure you know exactly who is representing you and how your agent is compensated. It outlines:

This agreement protects you by creating a clear, professional relationship—so you’re not on your own when it comes time to make one of the biggest financial decisions of your life.
In the past, these agreements weren’t always required, and many buyers didn’t realize that without one, no one was legally obligated to advocate for them. Now, this agreement makes sure you’re covered from day one.

How Are Buyer Agent Fees Paid?
Here are the three most common ways buyer’s agent fees are handled in Boise today:
- Seller-Paid: many home sellers are still offering to pay a commission to the buyer’s agent. These homes are listed that way from the start.
- Negotiated as Part of the Offer: even if a seller isn’t offering to pay a buyer’s agent upfront, we can ask them to cover the cost as part of your offer. I always make sure this is written into the contract, just like requesting closing cost help or repairs.
- Buyer-Paid: in some cases, you may be responsible for your agent’s fee yourself. If that happens, we’ll talk about what the cost looks like and how to plan for it.
